Non Nocere Bilgi Teknolojileri Eğitim ve Danışmanlık A.Ş. (“Non Nocere”) is committed to protecting the privacy of our users and ensuring their safety while using our services. This Privacy Policy (the “Policy”) has been prepared to process the personal data of our members in compliance with the Law on the Protection of Personal Data No. 6698 (“Law”) and inform them accordingly. The Non Nocere Cookie Policy is an essential part of this Policy.

The purpose of this Policy is to determine the terms and conditions regarding the use of personal data shared with Non Nocere -by Platform members/visitors/users (collectively referred to as the “Data Owner”) during the operation of the https://nonnocere.de website (the “Platform”) operated by Non Nocere- or generated by Non Nocere during the use of the Platform by the Data Owner.

Which data is being processed?

The information to be used and processed by a specific person is only possible if this person voluntarily enters data or expressly consents to this. Entering data or giving explicit consent in this regard is an indication that the person agrees with the following conditions. When visiting the Platform, some information is stored on the Platform servers.

Below are the data processed by Non Nocere, which are considered personal data in accordance with the Law. Unless otherwise expressly stated, the term “personal data” within the scope of the terms and conditions provided under this Policy shall include the following information.

In line with this data, some conclusions are drawn about the site user. However, this personal data can only be used anonymously. If this data is transferred to an external service provider, the necessary procedures are carried out to transfer it within the framework of the current legal regulations on data security.

If personal information is provided voluntarily, Non Nocere undertakes to use this information within the limits stipulated by Law or specified in the user’s declaration of acceptance and to process or transfer it within this framework.

However, according to Articles 3 and 7 of the Law, the data irreversibly anonymized will not be considered personal data in accordance with the provisions of the aforementioned articles of the Law, and the processing activities related to these data will be carried out without being bound by the provisions of this Policy.

Purposes of Personal Data Processing

Non Nocere may use the personal data provided by the Data Owner to carry out the necessary work by the business units in order to benefit the relevant persons from the products and services offered by Non Nocere (including the creation of membership registration and account and keeping records related thereto, enabling the Data Owner to benefit from the services provided through the Platform, monitoring performance by detecting system errors and improving the functioning of the Platform, providing maintenance and support services and backup services) and to carry out the relevant business processes, to plan and execute the activities necessary for the recommendation and promotion of the services and products to the relevant persons by customizing them according to the tastes, usage habits and needs of the relevant persons, to carry out the necessary work by the relevant business units for the realization of the commercial activities carried out by Non Nocere and to execute the related business processes, ensuring the legal, technical and commercial-business security of Non Nocere and the persons with whom it has a business relationship, and to plan and execute Non Nocere’s commercial and/or business strategies

Processing personal data with the explicit consent of data owners and for specific purposes.

Within the scope of the explicit consent of the Data Owner, Non Nocere may process data for the purpose of increasing the user experience by following the movements of the Data Owners on the Platform, creating statistics, profiling, direct marketing, and remarketing, creating special promotional proposals for the Data Owner and transmitting them to the Data Owner and using the data obtained within this scope in all kinds of advertising and material content, and may share this data with the parties Non Nocere has contracted with. Transfer of Personal Data

As part of the service provided, Non Nocere may obtain and transfer information about the Data Owner within the scope of this Policy. Such transfers of information are made in accordance with the terms established by third parties and existing contracts with third parties, and current legal legislation in force. This Policy does not reflect the privacy practices of third parties to whom information is transferred,  and Non Nocere is not responsible for its privacy policies or practices. This Policy does not cover information collected by applications outside of Non Nocere’s own control, information collected by websites and platforms of third parties, information collected by third parties through links on the Platform, or headlines, campaigns, and other advertisements or promotions on third party websites sponsored or participated by Non Nocere. Non Nocere is not responsible for the processing of personal data collected, stored, and used by third parties through their own websites.

Non Nocere may share personal data with outsourcing service providers, hosting service providers (hosting services), including those sending SMS, law offices, research companies, call centers, etc. in order to improve the Data Owner’s experience (including improvement and personalization), to ensure the security of the Data Owner, to detect fraudulent or unauthorized uses, to investigate operational evaluation, to eliminate errors related to the Platform services and to achieve any of the purposes contained in this Policy.

Personal data may be shared with Non Nocere, company officials, shareholders, business partners, suppliers, legally authorized public institutions and organizations and legally authorized private institutions within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of the Law, limited to these purposes can be transferred abroad within the framework of the procedural principles pointed out in Article 9 of the Law and the decisions of the Personal Data Protection Board.

The Platform may contain links to third-party websites, and this Policy does not apply to these websites. Non Nocere does not accept any responsibility for these websites.

Method of Collecting Personal Data and Legal Reason

Personal data is collected through the Platform and electronically. Personal data collected for the above-mentioned legal reasons may be processed and transferred for the purposes specified in Articles 5 and 6 of the Law and this Policy.

Personal Data Obtained Before the Entry into Force of the Law

Data collected before the effective date of the Law (07.04.2016), and consents obtained in accordance with the law before the effective date of the Law are considered to be in accordance with this Law unless contrary will is declared within one year. In order for the consent obtained before the effective date of the Law to be in accordance with the Law, it must comply with the general rules of law, and no declaration of will to the contrary has been made within one year.

Information Update and Change

Non Nocere may change the content of this Policy at any time in order to keep the privacy data protection principles up-to-date and in line with the relevant legislation. Changing Policy is announced on the Platform. It is possible to access the current version of the Policy continuously from the Platform. If, after the amendment of the Policy, the Data Owner continues to use the services or applications of Non Nocere, it is assumed that the Data Owner accepts these changes. The Policy amended by Non Nocere takes effect when it is published on the Platform.

Rights of the Personal Data Owner

In accordance with Article 11 of the Law, Data Owners are entitled to:

  • learn whether personal data related to them is processed or not, and if so, to request information about it,
  • learn the purpose of processing personal data and whether they are used in accordance with their purpose, to know the third parties to whom personal data are transferred domestically or abroad,
  • request the correction of personal data if it is incomplete or incorrectly processed and that the transaction carried out within this scope be notified to third parties to whom personal data are transferred,
  • request the deletion or destruction of personal data in the event that the reasons requiring the processing of personal data disappear, even though they have been processed in accordance with the provisions of the Law and other relevant laws, and that the transaction carried out within this scope be notified to the third parties to whom the personal data has been transferred,
  • request the withdrawal of consent in case of consent to the processing of personal data,
  • object to the occurrence of a result against himself by analyzing the processed data exclusively by means of automated systems and requesting compensation for the damage in case of damage due to the unlawful processing of personal data. Non Nocere will stop processing the data as long as it cannot prove that there is a substantial reason for the processing that exceeds the interests, rights, and freedoms that it must protect or legal claims are made in relation to this processing.

Within the scope of the Law, you can send all your requests,  complaints, and suggestions regarding your personal data to our address below with your petition containing documents confirming your identity and your request or send them to Non Nocere’s registered electronic mail address by using a secure electronic signature. Non Nocere will conclude such requests within thirty days. Non Nocere reserves the right to charge a fee based on the fee schedule (if any) determined by the Personal Data Protection Board for requests.
